Late payment rates by half-year
The reference rate is the European Central Bank rate in force on the first day of the half-year. The Ministry of Economy and Finance publishes it in the Official Journal; for transactions concluded from 1 January 2013, 8 points are added.

What is the late payment interest rate today?
In the second half of 2026 it is 10.40%: the ECB reference rate of 2.40% plus 8 points (Ministry of Economy and Finance notice, Official Journal no. 163 of 16 July 2026). In the first half it was 10.15%.
When does it apply?
To late payments in commercial transactions, that is contracts between businesses, or between businesses and the public administration, for the delivery of goods or the provision of services. It runs from the day after the due date, with no need for a formal demand.
What about contracts signed before 2013?
For transactions concluded before 1 January 2013 the margin was 7 points instead of 8. The calculator only covers the rules in force from 2013. Agricultural and food products also have their own rules, to be checked separately.
Can the parties agree on a different rate?
Between businesses, yes, within the limits of art. 7 of Legislative Decree 231/2002, which voids clauses that are grossly unfair to the creditor. The calculator uses the statutory late payment rate, the one that applies when the contract says nothing else.
What about the 40 euros?
Yes, art. 6 of Legislative Decree 231/2002 grants the creditor a flat 40 euros for recovery costs, on top of interest. The calculator shows interest only: add the 40 euros separately.
